Treason case: court tells prosecution to provide documents to defence

ISLAMABAD: The special court, on the request of former military dictator Pervez Musharraf' s legal team, has ordered the prosecution team in his high treason trial to provide the missing FIA investigation report and all relevant documents regarding the treason trial to the accused till Friday.

The defence lawyer had earlier complained that the papers and record already handed over was incomplete. A three-member special court headed by Justice Faisal Arab is conducting the treason trial. It has adjourned the hearing for today (Friday). During the proceeding of the case Musharraf's lawyer Shaukat Hyat submitted an application in the court and asked for the provision of relevant documents, including the minutes of the 44th session of the National Assembly (NA), list of members of the then cabinet (Shaukat Aziz and cabinet), list of advisers and attorneys general of the federal government and the list of provincial governors.

Shaukat Hyat also asked the court for a list of chief ministers, chief secretaries, home secretaries, inspector generals of police, members of the provincial assemblies and cabinets of the four provinces and a copy of the notification that replaced General Ashfaq Pervaiz Kayani as chief of army staff. The defence lawyer also sought the documents, including the names of the caretaker prime minister, members of the federal caretaker cabinet from November 2007 till December 15, 2007, and their present addresses; names of all the service chiefs and corps commanders as on November 3, 2007 and their present addresses.

Earlier, in his reply to the prosecution's application Musharraf prayed the special court to reframe the charges against him in the high treason trial and summon 10 witnesses listed in the prosecution's petition. Musharraf submitted that the witnesses who have been named in the application are under the control of the complainant so summons should be issued to them by the special court. Musharraf's lawyer submitted that no reason was disclosed as to why those mentioned in the list of witnesses were not summoned.

The defence lawyer argued that it indicates that the witnesses were not ready and willing to assist the petitioner. Earlier, the prosecution on the court's direction on May 14 provided copies of all the material pertaining to the investigation done by the FIA regarding the November 2007 emergency to Musharraf's lawyer. The prosecution also submitted an application which contained list of witnesses, requesting they be summoned.
