ISLAMABAD: Interior Secretary Shahid Khan on Thursday told the special court conducting the high treason trial of Pervez Musharraf that the former military ruler had issued orders for imposition of emergency in his personal capacity.

The special court was told by Shahid Khan that former military ruler Pervez Musharraf stood the "sole" accused in the high treason trial, as the Federal Investigation Agency (FIA) team found no evidence of his consultation with others before imposing emergency in November 2007, including corps commanders, joint chiefs of staff committee and federal cabinet.

A three-member bench of the special court headed by Justice Faisal Arab resumed the hearing of the treason trial on Thursday.

During cross-examination by the defence lawyer, the interior secretary stated that the FIA Joint Investigation Team (JIT) formed to investigate the matter found no evidence of Musharraf's consultation with anyone and that the former military ruler was the person who issued the orders of proclamation of emergency in the country.

Shahid Khan told the defence lawyer that the inquiry report prepared by the FIA held Musharraf as responsible for the imposition of emergency, after which the high treason trial was initiated against him. Answering a question of Nasim, the interior secretary said the record of the judges appointed and removed after the emergency is available with the Law Ministry. Shahid Khan informed the court that the FIA team tried its best to record the statements of the relevant army officials through the Ministry of Defence, but in vain.

The defence lawyer sought the interior secretary's opinion about the implementation of the Federal Rules of Business and whether armed forces come under the Ministry of Defence, to which he said that the forces do come under the jurisdiction of the ministry.

The defence lawyer then asked why other services chiefs' were not nominated in the treason trial who may be abettors in the case. Shahid Khan replied that the FIA investigation team held only Musharraf responsible for the imposition of emergency in November 2007 as he "signed the order" of the emergency.

He added that he received the findings of the FIA team in October 2013 and then filed the complaint against the former military ruler. The special adjourned the case till July 2.
