Musharraf announces remission in prisoners' sentences on eve of Milad

ISLAMABAD, April 21 (Online): President General Pervez Musharraf on Wednesday granted special remission in sentences to prisoners of different categories on the occasion of Eid Milad Un Nabi.
Exercising his prerogative under Article 45 of the constitution of Islamic Republic of Pakistan, 1973, the President on the advice of the Prime Minister, has been pleased to grant remission in sentences of 90-days to prisoners convicted for life imprisonment except those convicted of murder, espionage anti-state activities, sectarianism, Zina (Sec. 10 offences of Zina (Enforcement of Hudood) Ordinance, 1979 (also under Sec. 377 PPC), robbery (Sec. 394 PPC), dacoity (Sec. 395-396 PPC), kidnapping/abduction (Sec. 364-A and 365-A) and terrorist acts (as defined in the Anti-Terrorism (Second Amendment) Ordinance 1999 (No. XIII of 1999).
Special remission for 45 days to all other convicts except the condemned prisoners and also except those convicted of murder, espionage, subversion anti-state activities, terrorist act (as defined in anti-terrorism (Second Amendment) Ordinance 1999 (No. XIII of 1999), Zina (Sec. 10 offences of Zina (Enforcement of Hudood) ordinance 1079 (also under section 377 PPC), kidnapping/abduction (Sec. 364-A and 365-A) robbery (Sec. 394 PPC), dacoity (Sec. 395-396 PPC) and those undergoing sentences under the foreigners Act, 1946.
Special remission at sub-paras I and II above will be admissible provided that the convicts have undergone 2/3rd of their substantive sentences of imprisonment.
Total remission to male prisoners who are 65 years of age or above and have undergone at least 1/3rd of the substantive sentences of imprisonment, except those involved in culpable homicide and those in terrorist acts, as defined in the Anti-Terrorism (Second Amendment) Ordinance, 1999 (No. XII of 1999).
Total remission to male prisoners who are 65 years of age or above and have undergone at least 1/3rd of their substantive sentences of remission except those involved in culpable homicide and those involved in terrorist acts, as defined in the Anti-Terrorism (Second Amend) Ordinance, 1999 (No. XIII of 1999).
Total remission to female prisoners who are 60 years of age or above and have undergone at least 1/3rd of their sentence of impressments, except those involved in terrorists acts, as defined in the Anti-Terrorism (Second Amendment) Ordinance, 1999 (No. XIII of 1999).
Special remission of one year to female who have accompanying children and are serving sentences of imprisonment for crime other than culpable homicide and those involved in terrorists acts, as defined in the Anti-Terrorism (Second Amendment) ordinance 1999 (No. XIII of 1999).
Total remission to juvenile convicts (under 18 years of age who have served 1/3rd of their substantives sentences except those involved in culpable homicide, terrorist act, as defined in the Anti-Terrorism (Second amendment) Ordinance 1999 (No XIII of 1999), Zina (Sect. 10 offences of Zina (Enforcement of Hudood) Ordinance, 1979 9also under section 377 PPC), dacoity (Sec. 395-396 PPC), kidnapping/abduction (Sec. 364-A and 365-A) and anti-state activities. Those convict in cases processed by NAB will not be entitled to any remission. Those who have convicted on or before 21-04-2005 are entitled for the above said special remission.
