Article 62, 63 of the constitution equally applicable to president, member of assembly: former CJP

KARACHI: Former Chief Justice of Pakistan Justice (retd) Saeed ul Zaman Siddiqui and Justice (retd) Wajih ud Din Ahmad have said articles 62 and 63 of the constitution are equally applicable to both the President and members of assemblies adding the statement by the minister of parliamentary affairs Sher Afgan is not correct that these provisions are applied to only the members of the assemblies.

Talking to a private TV channel, former Chief Justice of Pakistan Saeed ul Zaman Siddiqui said all the provisions of constitution are applied to the contestant for presidential elections which are applied to every member of assembly. This can be personal opinion of Dr Sher Afgan. The final decision has to be taken by the Supreme Court in this connection, he added.

He went on to say all the matters will become clear after the nomination papers for the presidential elections are filed.

Justice (retd) Wajih ud Din Ahmad while talking to a private TV channel said the articles 62 and 63 of the constitution are applicable to the president after December, 31, 2004 even in the presence of 17th amendment . The election commission can not take any step or bring any change ultra vires to the constitution, he added.
